What Financial Institutions Must Know About the New AI Regulation in the EU

Training data is the fuel for AI. But in the financial sector, that fuel often includes deeply personal information—credit scores, transaction history, employment status. Under both the EU AI Act and GDPR, institutions must ensure that all data used respects individual rights.

The EU AI Act incorporates six dimensions of explainability: rationale (logic behind decisions), responsibility (who designed and oversees the system), data (how inputs affect outputs), fairness, safety/performance, and impact.

Evidence of explainability must be available at every step: logical diagrams, decision trees, confidence scores, and audit trails that connect cause (input) to effect (output). Financial institutions must train staff to interpret these insights and communicate them clearly to customers, regulators, and internal stakeholders.

This isn’t just a technical challenge—it’s a communications one. The better you can explain your AI, the more trust you’ll earn.


⚖️ 6. Spot and Fix Bias

Bias in AI is not hypothetical—it’s real and dangerous. In finance, biased algorithms can systematically exclude certain groups from credit, insurance, or investment opportunities.

Institutions must conduct bias audits, regularly test models for disparate impact, and retrain or revise systems that show unfair behavior. This includes examining training data for historical discrimination, and rebalancing datasets if necessary.

Transparency mechanisms must be in place to document bias detection efforts and the mitigation steps taken. Bias isn’t a one-time check—it’s a continuous responsibility.


📚 7. Keep Logs & Technical Documentation

Regulators and internal auditors need evidence. The EU AI Act mandates that institutions maintain detailed logs of how AI systems make decisions, what data was used, and what outcomes were produced.

This includes:

  • Data lineage (where it came from and how it was processed)
  • Version control for algorithms
  • Performance logs and incident reports
  • Documentation of testing procedures and explainability assessments

This documentation serves both accountability and operational continuity. If a system goes wrong, you need to know why—and fast.

Institutions must establish ethical review boards, stakeholder consultations, and clear processes for remediation of societal harm caused by AI outputs. Ethics should be embedded—not just in design, but in culture.

Moreover, an independent supervisory organ must be established to oversee government use of AI, safeguarding against abuse by political entities and maintaining public trust.
